律師的職業(yè)道道核心是誠(chéng)信。誠(chéng)信乃律師執(zhí)業(yè)的基本原則。律師要規(guī)范宣傳、規(guī)范 收費(fèi)。代理案件中要保守當(dāng)事人及國(guó)家的秘密。辦案過(guò)程中要處理好法官、檢察官、仲裁員及其他法律職業(yè)人員關(guān)系。
三、對(duì)律師職業(yè)技能感悟更深刻。
最為根本的就是以事實(shí)為依據(jù)，以法律為準(zhǔn)繩。要以一種心中永遠(yuǎn)充滿正義，目光不斷往返于事實(shí)和法律之間的心態(tài)辦理案件。對(duì)于案件客觀事實(shí)，一定要注意證據(jù)的收集與用，因?yàn)槭聦?shí)是建立在證據(jù)基礎(chǔ)上，事實(shí)是靠證據(jù)來(lái)證明的。對(duì)于案件適用的實(shí)體法律、法規(guī)、司法解釋，一定要要研究透。對(duì)其立法目的、立法精神、適用范圍、條件務(wù)必吃透。對(duì)程序法律一定要非常嫻熟，因?yàn)槌绦蚰藢?shí)體公正的保障。
四、對(duì)法律職業(yè)和法律人的理解更透徹。
在實(shí)習(xí)中，通過(guò)從事具體的律師實(shí)務(wù)，對(duì)法律職業(yè)或法律人的理解不斷深化，越來(lái)越體會(huì)到理論與實(shí)踐的差異，理論與現(xiàn)實(shí)的沖突，再往后執(zhí)業(yè)中應(yīng)特別注意和克服這些差異和沖突?？慈松賾B(tài)，觀社會(huì)風(fēng)云，這正是律師行業(yè)的魅力之所在。社會(huì)發(fā)展、情勢(shì)變遷、新的問(wèn)題，新的思維，只有努力學(xué)習(xí)、勇于創(chuàng)新實(shí)踐，再能與時(shí)俱進(jìn)。
實(shí)習(xí)期間，對(duì)律師實(shí)務(wù)、及辦案流程有了更深刻、更直觀的認(rèn)識(shí)，具體包括：
一、空閑時(shí)間經(jīng)常拿執(zhí)業(yè)律師已辦結(jié)案件的卷宗，進(jìn)行學(xué)習(xí)，看看他們最后是怎么處理雙方爭(zhēng)議的焦點(diǎn)。從中即學(xué)會(huì)了執(zhí)業(yè)律師辦理案件的整個(gè)流程，也了解到庭審的各環(huán)節(jié)，認(rèn)真觀摩了執(zhí)業(yè)律師舉證、質(zhì)證、辯論全過(guò)程。
二、旁聽(tīng)案件。對(duì)案件審理并非我們現(xiàn)象中的那樣充滿激情和動(dòng)人心魄。實(shí)際中的民事審判很多程序性問(wèn)題都省略了，覺(jué)得庭審嚴(yán)格但又靈活的一面。
三、跟執(zhí)業(yè)律師到法律援助中心、工商局、派出所等部門(mén)調(diào)查取證。在調(diào)查取證過(guò)程中會(huì)，深深感受和體會(huì)到律師執(zhí)業(yè)的重大意義，也體會(huì)到律師在刑辯中獲得案卷材料的有限。
四、其他諸如蓋章、整理案卷材料、復(fù)印材料、送達(dá)文件、領(lǐng)取判決裁定。在一年實(shí)習(xí)期間里，我們配合所內(nèi)勤，幫忙做一些力所能及的事情。
為加強(qiáng)和鞏固學(xué)習(xí)效果，我做了以下事情：
一、理論指導(dǎo)實(shí)踐，理論結(jié)合實(shí)踐。課堂上的理論與實(shí)際的工作常有脫節(jié)的地方，這常是我們的疑問(wèn)。這讓我們深刻認(rèn)識(shí)到法學(xué)是一門(mén)實(shí)踐性很強(qiáng)的社會(huì)科學(xué)，法學(xué)教育和實(shí)踐的確是有一段距離的。對(duì)此，我們抓住每一次機(jī)會(huì)提高自身業(yè)務(wù)素質(zhì)，促進(jìn)知識(shí)向踐行的轉(zhuǎn)化。
二、階段性總結(jié)。隨時(shí)記錄自己的心得體會(huì)，也許是粗淺的認(rèn)識(shí)，也許是一點(diǎn)點(diǎn)小小的意見(jiàn)與建議。但就是這一點(diǎn)點(diǎn)經(jīng)驗(yàn)與真知，才是真正的收獲。及時(shí)與同實(shí)習(xí)的律師交流、互通信息、交流心得、分析實(shí)習(xí)中遇到的問(wèn)題，并采取相應(yīng)的措施。
總的來(lái)說(shuō)，在實(shí)習(xí)期間，我深刻感受到律師的責(zé)任與壓力。很多法律現(xiàn)象和法律事實(shí)，不是單純依靠法學(xué)理論和法律條文所能解決的。法律本身的漏洞和法律制度的弊端，個(gè)人是無(wú)法克服的，需要整個(gè)法律界以及全社會(huì)為之努力，才可能改變。作為一名律師，更重要的是在事實(shí)和法律之間尋求平衡。這不僅需要扎實(shí)的基本功，還需要有駕馭社會(huì)的藝術(shù)。然而，我在以下方面仍需改進(jìn)：
1、 業(yè)務(wù)學(xué)習(xí)
一年來(lái)，通過(guò)從事具體的律師業(yè)務(wù)，自己對(duì)法律的理解不斷加深，也越來(lái)越體會(huì)到理論也實(shí)踐的差異。一條看似明確的法律規(guī)定，運(yùn)用到現(xiàn)實(shí)中，問(wèn)題層出不窮，一個(gè)看似簡(jiǎn)單的實(shí)際問(wèn)題，反饋到法律上，往往模棱兩可，而在自己進(jìn)入律師行業(yè)以前對(duì)這種現(xiàn)象可能既看不到，也想不到，而正是律師賴以生存的空間，實(shí)習(xí)一年，自認(rèn)為在業(yè)務(wù)上最大的收獲不是理解了多少法條，學(xué)會(huì)了多少技巧，而是明白了終身學(xué)習(xí)能力對(duì)于一個(gè)律師業(yè)務(wù)發(fā)展和業(yè)務(wù)能力的重要性。
2、執(zhí)業(yè)態(tài)度
一年來(lái)，跟隨所里面各個(gè)律師辦理業(yè)務(wù)，勤奮和認(rèn)真是他們共同的特點(diǎn)，這給我感受很深，這是一個(gè)律師應(yīng)有的職業(yè)態(tài)度，在這一點(diǎn)上我要檢討自己的惰性和準(zhǔn)備不足，這反映自己對(duì)律師工作的認(rèn)識(shí)和從事律師執(zhí)業(yè)仍顯準(zhǔn)備不足。律師不僅不是一個(gè)輕松休閑的職業(yè)，而且是一個(gè)充滿挑戰(zhàn)、需要付出艱辛的工作，獨(dú)立、勤奮、認(rèn)真是一個(gè)律師必須具備的執(zhí)業(yè)態(tài)度。人固有惰性，但為了從事的職業(yè)和自我實(shí)現(xiàn)，必須克服這種惰性，和依賴，以自我實(shí)現(xiàn)成為習(xí)慣，而不是惰性和依賴。
3、人際交往
良好的交際能力是一個(gè)優(yōu)秀律師必備的素質(zhì)，自己在人際交往上還存在缺陷，一年實(shí)習(xí)期，在這方面還未得到多大改善，緊張、無(wú)序、混亂、拘謹(jǐn)?shù)膱?chǎng)面依然如故，這應(yīng)該是缺乏自信的表現(xiàn)。對(duì)此，在以后的執(zhí)業(yè)過(guò)程中，自己要盡可能多學(xué)習(xí)、充實(shí)自己，提升自信心，人際交往從日常生活做起，從身邊做起，做到不卑不亢，不急不躁，在人際交往中找到自己，實(shí)現(xiàn)自己。
經(jīng)過(guò)一年的實(shí)習(xí)，我深刻認(rèn)識(shí)到，終身學(xué)習(xí)能力對(duì)于一個(gè)律師業(yè)務(wù)發(fā)展和業(yè)務(wù)能的重要性。以前的學(xué)習(xí)只是為從事律師職業(yè)打下了一些基礎(chǔ)，或者說(shuō)是僅僅為了邁向律師殿堂的門(mén)檻。社會(huì)飛速發(fā)展，新的情勢(shì)不斷變化，法律持續(xù)更新，現(xiàn)在是一個(gè)學(xué)習(xí)型的社會(huì)，根本不存在一勞永逸的學(xué)習(xí)，律師行業(yè)更是如此，沒(méi)有自我更新能力的律師注定是要被淘汰的。成長(zhǎng)為一名合格的執(zhí)業(yè)律，不僅僅要不斷學(xué)習(xí)專業(yè)理論知識(shí)，還要學(xué)習(xí)與之相關(guān)的各學(xué)科知識(shí)。
